<p>Kid's resale, consignment and thrift stores are NOT 'exempt' from the law called CPSIA.</p>
<p>This poorly written, sweeping legislation applies to ALL children's products for children aged 12 years and younger. If a resale, thrift or consignment store is found to contain any product, with any ONE PART of it that tests at over 600 ppm the owner can be held on civil and criminal charges! Fines of $100,000 or more and jail time! While NO RETAILER, under this law is required to test products, the poor wording in this law does not explain exactly HOW we are to KNOW if ANY ONE PART or component of any kid's item, including clothing contains over 600 ppm of lead - tada - unless it is tested. While the CPSC 'says' they don't 'intend' to focus on inspecting kid's resale, consignment and thrift shops - WE WANT IT IN WRITING!</p>
<p>WE WANT TO BE LEGAL! Help us! This affects your kid's school library, public libraries; eBay, craigslist and etsy.com sellers, makers on handmade kid's products and clothing, handmade kid's toys, school supplies, religious supplies like rosaries, bikes, telescopes used in science experiences, stuff sold at amusement parks and MORE!</p>

Nothing has changed. </span></strong></p>
<p>The press release personally insulted my intelligence and offended me as an American taxpayer with valid concerns that remain unaddressed, in public, on television by any of the governmental officials and legislators whose salaries we pay<strong>. <br /></strong></p>
<p>We're an intelligent and insightful nation. <strong>Apparently Washington thinks we're not very bright. They think this press release will shut us up while they change nothing.</strong></p>

<p>As Adele, from <a href="http://www.narts.org">NARTS</a> has said, This "press release", issued to provide clarification to the resale market, is a <strong>double edged sword</strong>!</p>
<p>This is<strong> not </strong>a ruling, it's <strong>not </strong>an exemption, it's an attempt to quell the groundswell. Please keep up the good work, folks.</p>
<p><strong>From a post Cynthia made on another board - here's her interpretation:<br /></strong></p>
<ul>
<li>No clarification was made at all, not one thing (GC's were never required for products made prior to November 12th).</li>
<li>The law as CPSC interprets is what they say it is unless CONGRESS AMENDS THE LAW</li>
<li>That the CPSC is overwhelmed by all the phone calls and letters and is also been getting lots of pressure from Congress to try and figure out a way to make this hue and cry - and all the darn phone calls, em's and letters go away - now - and get the press to stop reporting about it</li>
<li>That the CPSC doesn't have enough funding to effectively police all the yard sales, eBay, Craigslist and resale and thrift shops - but, if an inspector does catch you - you are toast.</li>

<p>It will also effectively put most home-based and small, organic kid's clothing and toy maker's out of business at a time when so many Americans are already losing their jobs.</p>
<p><a href="http://www.cpsc.gov/about/cpsia/legislation.html">The law</a> is complicated. The law is poorly written and confusing. <em>Most Americans have no idea of the sweeping repurcussions this law will have across so many industries, many individual families and our nation's environment - especially landfills.</em> <a href="http://www.thesimpledollar.com/2009/01/03/hand-me-down-clothes-in-the-post-hand-me-down-era-consumer-protectionism-gone-too-far/#comments">Read</a> <strong>lots of very recent consumer comments on hearing of the law!</strong></p>
<p>Worse, many children's resale, consignment, thrift and annual/bi-annual kid's resale event owners and operators, both bricks and mortar and on-line, have no yet heard about this law. They have no idea, or are just now learning, that February 10th all of their merchandise in their inventory will be considered 'banned hazardous products' according to this Federal law.</p>
